建筑工程合同风险管理

摘要

在工程项目中，由于人们的认识能力有限、工程周期长，在此期间客观条件

可能发生变化，对协议的执行产生干扰。这种客观存在的对合同履行的不确定性

会带来合同的风险。而且现阶段建设工程相关企业的合同管理水平普遍低下，合

同管理混乱，缺乏相应合同管理人才，合同的签订及履行过于草率，使得建设

工程合同从签订到履行存在很多风险因素。如何控制合同风险，防范合同风险造

成的损失，已成为建设工程项目管理业主方需要重点关注和探讨的一个课题，

本文正是在此背景下开展研究的。

本文首先的对建筑工程合同风险管理的研究背景、国内外研究现状与研究意

义进行了阐述，之后对建设工程合同的类型和特征进行详细的分析，给出合同

风险的主要表现形式、风险的类型与风险的来源，针对上述的风险类型与来源给

出合同风险管理的一般过程与防范策略，最后从正反两个例子进行分析建筑工

程合同风险管理的方法。

Abstract

In engineering project, because people know ability is limited, project cycle is long, during which

the objective conditions may change for execution of this agreement, the disturbance. The

objective existence of the uncertainty of the contract will bring the contract risks. And the present

construction engineering related enterprise contract management level universal is low, contract

management confusion, lack of corresponding contract management talent, contract signing and

perform too hasty and makes the construction project contract signed to perform from existing

many risk factors. How to control the contract risks, prevent the loss caused by the contract risks,

has become the construction project management owner require focus on a task and explored in

this background, this paper is carried out under study.

This paper first to the building project contract risk management research background, research

status and research meaning is described, of the construction project contract after the type and

characteristics, gives a detailed analysis of the major form of the contract risks, risks types and

sources of risk to the types of risk, with sources of risk management are contract with general

process of preventive strategy, finally analyzed negative examples from architectural engineering

contract risk management method.
