浅析我国工伤保险法律制度

摘要

工伤保险作为社会保障的重要组成部分，是一种强制性的保险制度，具有防范和化解风

险的功能和作用。它不但直接关系到每一位劳动者的切身利益，也间接影响到整个社会稳定

及国家经济发展。本文以我国工伤保险法律制度为研究主题，共分四个部分。第一部分，工

伤保险概述。本部分阐述了工伤保险的概念以及工伤保险的的特点和基本原则。第二部分，

论述了我国工伤保险法律制度存在的问题，结合我国工伤保险与民事侵权赔偿法律适用的现

状，从民事侵权赔偿在工伤事故处理中的必要性及用人单位承担工伤事故侵权责任的合理性

两方面对工伤保险与民事侵权赔偿责任适用关系进行了探讨。第三部分，完善我国工伤保险

法律制度的思考。该部分阐述了完善工伤保险制度的积极意义和完善的具体措施。

浅析我国工伤保险法律制度

Abstract

The industrial injury insurance, as an important component of the social security system, is a

compulsory insurance with the function and effect to prevent and fend off the risk of accidents,

which embodies the idea of fairness and justice of Human society. This thesis is dedicated to the

topic on the industrial injure insurance system, which is made up of four parts. Part one is mainly

about the general theory of industrial injury insurance system and defines industrial injury

insurance，and gives the characteristics and the basic principles of the industrial injury insurance.

Part two is the problem of our industrial injury insurance system. This part is connected with the

relationships between the industrial injury insurance and civil torts. And on the basis, of analysis, it

talks about the adaptation of laws. Part three is about the thoughts of how to improve the legal

system of industrial injury insurance .The content contains the positive significance of

improvement and the specific measures.
